Terms of use of application HealthCar

These Terms & Conditions (“Terms”) govern the use of the HealthCar mobile application (“Application”), operated by Andrej Mikoláš (“Operator”, “we”, “us”).

By using the Application, you agree to these Terms.

If you do not agree with these Terms, do not use the Application.

1. Definitions

  • User – a natural person using the Application.
  • Account – a user registration in the Application (email or Google Login).
  • Vehicle – any vehicle recorded by the User.
  • Evidence Item – a document, service action, inspection, or any other vehicle-related record.

2. Nature of the Application

HealthCar is a digital tool designed to help users manage information about their vehicles, including:

  • recording documents and service operations,
  • reminders based on date or odometer,
  • ODO meter handling (including AI OCR extraction),
  • history of performed actions,
  • uploading photos (documents, ODO readings, service events),
  • push notifications,
  • management of multiple vehicles.

The Application does not replace professional car servicing, mandatory technical inspections, or any legal obligations of the User.

3. Registration and User Account

Users may sign in using:

  • email and password,
  • Google Login.

Users are required to:

  • provide accurate and up-to-date information,
  • protect their login credentials,
  • not allow third parties to access their account.

The Operator may suspend or terminate an account if these Terms are violated.

4. Data Security and Processing

We process only the data necessary for the Application to function, including:

  • user email and preferences,
  • vehicle information,
  • service and document records,
  • photos uploaded by the User,
  • data extracted via AI OCR (e.g., odometer readings),
  • push notification tokens,
  • logs and diagnostic data.

Further details are described in the Privacy Policy, which forms an integral part of these Terms.

5. User-Generated Content

The User is responsible for all content uploaded to the Application, especially images and notes.

Users are prohibited from uploading:

  • content infringing intellectual property rights,
  • illegal, offensive, or harmful content,
  • any data unrelated to the Application’s functions.

The Operator may remove such content without prior notice.

6. AI OCR and Notifications

The Application uses automated image processing (OCR) to detect odometer values.

The User acknowledges that:

  • AI/OCR results may contain errors,
  • it is the User’s responsibility to verify extracted values,
  • reminders and notifications may not always be delivered (due to device limitations, system behavior, or FCM delivery issues).

The Operator is not liable for damages resulting from:

  • incorrect OCR readings,
  • missed service actions,
  • expired documents or inspections,
  • undelivered notifications.

The User remains fully responsible for verifying the accuracy of their records.

7. Intellectual Property

The Application and its content (texts, illustrations, icons, design, database templates, application logic) are protected by copyright and intellectual property laws.

Users may not:

  • copy, distribute, or modify the Application’s content,
  • reverse engineer the Application,
  • create derivative works without the Operator’s permission.

8. Limitation of Liability

The Application is provided “as is”.

The Operator is not liable for:

  • any damages caused by incorrect or incomplete data,
  • outdated information submitted by the User,
  • server downtime, delayed notifications, or technical outages,
  • damages caused by incorrect service actions,
  • consequences of missed inspections, expired documents, or insurance lapses.

Users are always responsible for checking the accuracy of their data.

9. Account Deletion

Users may delete their account directly in the Application.

Upon deletion:

  • all personal data will be removed,
  • certain system logs may be temporarily retained (without identifiable information),
  • deleted data cannot be restored.

10. Availability and Changes to the Service

The Operator may:

  • update the Application,
  • modify its functionality,
  • temporarily or permanently discontinue the service.

Users will be informed of significant changes.

11. Changes to the Terms

We reserve the right to update or modify these Terms.

Continued use of the Application after changes are published constitutes acceptance of the revised Terms.
